Court Maintains ₦300 Million Illegal Eviction Case Against Property Developer and Co-defendants

A Maitama-based Federal Capital Territory High Court has rejected attempts to dismiss a high-profile illegal eviction case involving property developer Cecil Osakwe and two others, maintaining that the prosecution must continue to ensure justice is served.

During the latest hearing, the court faced another setback in the case (FCT/HC/CR/22/2023) when Inspector Edith Erhunmuuse, the third defendant, failed to appear, citing health issues without providing medical documentation. The prosecution also requested a postponement due to international commitments.

Justice Samira Bature, who presides over the case, remained firm despite objections from defense counsels. The first defendant’s lawyer, Mr. Ayuba Kawu, and second defendant Victor Giwa, who represented himself, strongly opposed the adjournment and pushed for the case’s dismissal.

The judge acknowledged the multiple delays but ruled in favor of giving the prosecution another opportunity, emphasizing the court’s commitment to fair hearing for all parties. Justice Bature specifically instructed the third defendant’s counsel, Mr. C C Onyechere, to ensure his client’s presence at the next hearing and proper service of notice to the prosecution.

The case centers on a nine-count charge against the three defendants – Cecil Osakwe (property developer), Victor Giwa (legal practitioner), and Inspector Edith Erhunmuuse. They stand accused of illegally evicting occupants and causing property damage valued at ₦300 million. The Federal Republic of Nigeria serves as the complainant in this criminal proceeding.

The matter has been rescheduled for arraignment on February 3, 2026. Justice Bature indicated that pending applications from the defendants would be addressed when the prosecution is present to respond, underscoring the court’s dedication to maintaining procedural fairness in this significant property rights case.
